1. Scope of Application
These General Terms and Conditions (GTC) apply to all deliveries by KOKUA Bikes GmbH to consumers (§ 13 BGB).

3. Offer and conclusion of contract
3.1 The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to order. Errors excepted.
3.2 By clicking on the order button in the last step of the ordering process, you place a binding order for the goods listed on the order page. The purchase contract is concluded when we accept your order by means of an order confirmation by e-mail immediately after receipt of your order.
4. Right of withdrawal for consumers
Withdrawal:
You can revoke your contractual declaration within two weeks without giving reasons in text form (e.g. letter, fax, e-mail) or – if the item is handed over to you before the deadline expires – also by returning the item. The period begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery) and also not before fulfilment of our information obligations pursuant to Section 312c (2) of the German Civil Code (BGB) in conjunction with Section 1 (1), (2) and (4) of the German Civil Code (BGB-InfoV) as well as our obligations pursuant to Section 312g (1) sentence 1 of the German Civil Code (BGB-InfoV) in conjunction with Section 3 of the German Civil Code (BGB-InfoV). In order to comply with the revocation period, it is sufficient to send the revocation or the item in good time. The revocation must be addressed to:

Consequences of revocation:
In the event of an effective revocation, the services received by both parties must be returned and, if applicable, any benefits derived by us (e.g. interest) must be returned. If you are unable to return the service you have received in whole or in part, or only in a deteriorated condition, you may have to pay us compensation for the value of the service. This does not apply to the transfer of goods if the deterioration of the goods is solely due to their examination – as you would have been able to do in a shop, for example. You do not have to pay compensation for any deterioration caused by the intended use of the item. Items that can be sent by parcel must be returned at our risk.You have to bear the regular costs of the return shipment if the delivered goods correspond to the ordered goods and if the price of the goods to be returned does not exceed an amount of 40 euros or if you have not yet provided the consideration or a contractually agreed partial payment at the time of revocation in the case of a higher price of the goods. Otherwise, the return is free of charge for you. Items that cannot be sent by parcel will be collected from you. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of your declaration of revocation or the item, for us with its receipt.
The right of withdrawal does not apply to distance contracts
- for the delivery of goods that are manufactured according to customer specifications or
- are clearly tailored to personal needs.
4a. Return costs when exercising the right of withdrawal
If you make use of your statutory right of withdrawal (see cancellation policy), you must bear the regular costs of the return shipment if the delivered goods correspond to the ordered goods and if the price of the goods to be returned does not exceed an amount of 40 euros or if you have not yet provided the consideration or a contractually agreed partial payment at the time of revocation if the price of the item is higher. Otherwise, the return is free of charge for you.
5. Prices and shipping costs
5.1 The prices stated on the product pages include VAT and other price components.
5.2 Additional shipping costs:
Up to a value of 100.00 € we charge 5.95 € shipping costs for shipping within Germany. From a value of goods of 100.00 € we ship free of charge within Germany, Austria, France, Luxembourg and the Netherlands. To all other countries to which we offer shipping, we ship free of charge from a value of goods of € 120.00.
Please ask for the exact shipping costs for shipping to other EU or third countries.
6. Delivery
6.1 Delivery is made within Germany by Deutsche Post/DHL.
6.2 The delivery time is usually up to 5 working days. We will point out any deviating delivery times on the respective product page.
7. Payment
7.1 Payment is made in advance by bank transfer or payment by PayPal.
7.2 You are only entitled to offset if your counterclaims have been legally established by a court or are undisputed or have been acknowledged by us in writing.
7.3 You can only exercise a right of retention if the claims result from the same contractual relationship.
8. Retention of title
Until full payment has been made, the goods remain our property.
